Other Accidents

 

If the accident that happened to you was the result of other people’s negligence, you may bring a civil claim against the negligent party(ies). For example, you may bring a claim if you were injured when a waiter pours hot water onto your body inadvertently while serving tea. You may also bring a claim if you slipped and fell in a shopping mall because the floor was not kept reasonably dry and clean, etc.

 

Please note that under the laws of Hong Kong, there are limitation periods for bringing personal injury claims in court. The following shows the time frames for some of the common personal injury claims:

 

Compensation for work- injured employees
You must submit your application to the court within 2 years from the date of the accident.

 

Negligence and medical negligence claims

You must file a claim to the court within 3 years from the date of the accident.

 

Claim for accident happened in the airplane or vessel
You must file a claim to the court within 2 years from the date of the accident.
